Alleged Sexual Harassment: Prof Ndifon Fights Back

…Says he had consensual relationship with Diplomat Student

Professor Cyril Ndifon being prosecuted by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) over alleged sexual harassment against female students of the university of Calabar, has debunked allegations levelled against him by the University authority, describing the allegations as lies cooked up just to tarnish his image.

Ndifon argued that all the allegations leveled against him were concocted and falsified, noting that he is blameless and the trial is a social media trial orchestrated by some persons in the University of Calabar against him.

The professor maintained that the 22-year-old star witness, simply identified as TKJ, had a consensual relationship with him going by the series of chats between them. TKJ (not real name), a girl who is officially 22years, 7months is an adult who was in a consensual relationship. At almost 23years, TKJ is not a child under the childs rights act.

Investigations has revealed that TKJ sought for Ndifon’s phone number personally and contacted him by herself. WhatsApp messages also showed that TKJ as an adult did everything willingly as there was no coercion or force. Counsel to Ndifon had also called TKJ with the hope of making her a star witness during the trial before the ICPC hurriedly coerced her against Ndifon.

Ndifon: Thanks. Did you read my post.

TKJ: I read it Sir. I heard they have lots of evidence against you. I also heard that a lot of past students are willing to testify against you.They have plans.

Ndifon: Past students? Who have graduated? They should go to my village and look for more people

TKJ: They said they will come and testify.

Ndifon: That they never had the option to do so when they were students? Where’s the allegation? Is the query I had or it’s new? Are you following me?

TKJ: Yes Sir. Omor!!? Sir, these people should rest abeg.

Ndifon: They are totally ignorant. Do I look like a coward?

TKJ: Not at all, Sir. Missing you Daddy.

Ndifon: I am aware. You just be careful too. But you will have your admission.

TKJ: Alright Sir. Thank you. How’s your family? Hope they are not believing all of these?

Insisting that the relationship is consensual, Ndifon has therefore filed his no-case submission before the Federal High Court, Abuja, against the amended suit instituted against him by the Independent Corrupt Practices and Other Related Offences Commission (ICPC), saying that the complaints against him was a 2015 case which the police had cleared him of no wrong doing.

In the professor’s no-case submission filed by Agi, a Senior Advocate of Nigeria, he told Justice James Omotosho that “evidence before the court (Exhibit “H” ) shows that text messages between his client and TKJ were that of emotional feelings between two lovers and did not in any way put either of the party under fear.”

He stated that the “unwholesome and illegal intrusion” into the phone of his client by the complainant has now put before the whole world what TKJ and the 1st defendant intended to be a personal and private communication, thus injuring and negatively impacting their characters and persons”.

Agi has therefore urged the court to decline jurisdiction on the case because, under cross-examination, PW1 asserted that they received several oral and written complaints but never mentioned TKJ as one of such complainants and that TKJ was not even listed as a witness in the originating charge but “surfaced after the amended charge was filed”.

He further submitted that Prof Ndifon committed no crime, and that the court had no jurisdiction to try him as the alleged offence took place in Calabar, and not Abuja.
